The
U.S. Department of Health and Human Services (HHS) is seeking an attorney to
join the Office of the General Counsel (OGC) in Kansas City, Missouri. OGC provides comprehensive legal services to
the agencies within HHS, including the Office for Civil Rights (OCR), the
Centers for Medicare and Medicaid Services, the Administration for Children and
Families, and the Public Health Service.
OGC-Region 7 in Kansas City is home to five attorneys and one support
staff. The applicant must be able to
work independently and as part of a team with bot! h the regional office staff
and the 400+ OGC colleagues ac! ross the nation.

This position is focused on providing legal services to the regional Office for
Civil Rights, though the attorney may be asked to serve any of the client
agencies within HHS. The HHS Office for
Civil Rights ensures that people have equal access to HHS-funded services
without facing unlawful discrimination.
OCR provides public education and technical assistance, investigates
complaints, and conducts nondiscrimination compliance reviews involving
entities that receive HHS funds or assistance.
OCR also ensures the privacy of individually identifiable health
information under the Health Insurance Portability and Accountability Act
(HIPAA) Privacy Rule, the security of electronic protected health information
under the HIPAA Security Rule, the confidentiality of identifiable information
being used to ana! lyze patient safety events under the Patient Safety Rule, as
well enforcing the breach notification provisions of the HIPAA Breach

Serves as legal advisor to the Office for Civil Rights (OCR) Regional Manager, OCR Regional Division Director, and OCR Branch Chiefs on all civil rights matters requiring legal interpretation or guidance. Acts as the pri! ncipal attorney in administrative hearings, court actions, and other pr! oceeding of considerable difficulty and complexity. Analyzes pertinent factual and legal issues and questions for adequacy of evidence, the impact and importance of the litigation or administrative enforcement of court action. Prepares memoranda and materials concerning substantive issues, findings, and facts, conclusions of law, and the advisability of pursuing further litigatory action appeal, or other appropriate disposition. Participates in negotiations and directs attorneys in negotiations of matters of considerable complexity with officials of Federal, state, local government, including state health, welfare and education appointees and elected officials, university officials, government contractors and grantees, and private attorneys. Prepares formal justification for referral to the Department of Justice. QUALIFICATIONS REQUIRED:

Education: Successful completion of a full course of study in a school of law accredited by the American Bar Association t! hrough which you have attained the first professional law degree, i.e., LL.B. or J.D.

Bar Membership: You must currently be a member in good standing of the Bar of a state or territory of the United States, or the Commonwealth Puerto Rico.

For GS-11 Grade Level:
Possess up to one (1) year of professional legal experience after admission to the bar, equivalent to the GS-9 grade level in the Federal service working with Federal/state/local civil rights statutes and/or Health Insurance Portability and Accountability Act of 1996 (HIPAA) and demonstrated experience in Federal/state/local court or administrative ! litigation.

For GS-12 Grade Level:
Possess between ! one (1) and two (2) years of professional legal experience after admission to the bar commensurate with the duties of the position and at least one year is equivalent to the GS-11 grade level in the Federal service working with Federal/state/local civil rights statutes and/or Health Insurance Portability and Accountability Act of 1996 (HIPAA) and demonstrated experience in Federal/state/local court or administrative
litigation.

For GS-13 Grade Level:
Possess between two (2) and three (3) years of professional legal
experience after admission to the bar commensurate with the duties of the
position and at least one year is equivalent to the GS-12 grade level in the Federal service working with Federal/state/local
civil rights statutes and/or Health Insurance Portability and Accountability Act of 1996 (HIPAA) and demonstrated experience in Federal/state/local court or administrative litigation.

For GS-14 Grade Level:
Poss! ess more than three (3) years of professional legal experience after admission to the bar commensurate with the duties of the position and at least one year is equivalent to the GS-13 grade level in the Federal service working with Federal/state/local civil rights statutes and/or Health Insurance Portability and Accountability Act of 1996 (HIPAA) and demonstrated experience in Federal/state/local court or administrative litigation.

Foreign Education: If you are using education completed in foreign colleges or universities to meet the qualification requirements, you must show that the education credentials have been evaluated by a private organization that specializes in interpretation of foreign education programs and such education has been deemed equivalent to that gained in an accredited U.S. education program; or full credit has been given for the courses at a U.S. accredited college or university.
